Synopsis

Our client, a global financial organisation, is seeking an Investigations Officer to examine and investigate complex matters mostly of a technical accounting/financial nature to identify potential breaches by regulated parties of International Financial Reporting Standards and the company requirements and to take appropriate action in terms of the Financial Markets Act.

Description

  • Provide specialist accounting/financial advice and opinions on the interpretation and application of the Listings Requirements and IFRS.
  • Identify alleged breaches of Listings Requirements and IFRS and conduct a full investigation thereof in a fair, thorough and objective manner whilst adhering to due investigative process.
  • Monitor and manage challenging turnaround times for recorded cases of alleged breaches of the Listings Requirements and/or IFRS to ensure that investigations are processed efficiently and timeously.
  • Deal independently with complex investigations, which includes delegating certain research tasks to other investigators, pulling information from different sources together and drafting correspondence, reports and memorandums required for a finding of breach, objections and censure/penalties.
  • Make recommendations on the findings of breach/objections and censures.
  • Assist the Financial Sector Conduct Authority with investigations referred to the company.
  • Represent the unit internally for project or task completion.
  • Interact professionally with stakeholders by being objective and fair in the approach to gather information, legal issues and feedback/advice to relevant parties.
  • Provide comfort to external clients by adhering to best regulation practices and enforcement of due processes within the confines of the Financial Markets Act.
  • Understand and meet clients' needs by continuous communication with regulated and interested parties on the application of the Listings Requirements and IFRS and the status of an investigation.
  • Build constructive relationships with colleagues, peers and sponsors for consultation, knowledge sharing and training on technical concepts, matters or standards by communicating in a professional manner and by effectively addressing any issues that arise.
  • Deal with objections and appeals from clients in relation to the decision taken by the investigation’s unit.
  • Develop processes against best legal practice to investigate and make a finding that is reasonable, fair and objective in terms of the Listings Requirements, Administrative Law and Financial Markets Act to prevent legal action against the company.
  • Attend to external complainant’s issues as quickly and effectively as possible, whilst ensuring due investigative process.
  • Follow and enforce an efficient censures/penalties process against regulated parties in a manner which is fair, thorough and systematic to ensure that decision makers have all the required information to make an informed decision.
  • Ensure that the Issuer Regulations Division fulfils its responsibilities in terms of the Financial Markets Act to promote the company's reputation, transparency and integrity of the investigations.
  • Manage own delivery against business delivery plan and set timelines, identify obstacles to delivery and take appropriate action where required.
  • Manage and report on risk issues by identifying and understanding threats to the reputation of the company as a credible regulator and taking necessary action to mitigate these threats.
  • Draft reports and champion projects which require research and consultation with external and internal parties on an ad hoc basis.
  • Work with, interact and consult with other divisional members to achieve a common goal or purpose.
  • Draft correspondence/memorandums/reports with accurate content in a coherent and structured manner.
  • Partake in and lead meetings with internal and external parties in a professional and confident manner.

Requirements

  • Chartered Accountant (SA).
  • A minimum of 5 years post qualification experience in analysis of financial statements for compliance with IFRS and/or advising on the application of IFRS and/or projects involving the implementation of IFRS.
  • Postgraduate studies in IFRS.
