Synopsis

Our client, a leading financial service group is currently seeking an individual to assume the role of Senior Regulatory Compliance Specialist. The successful incumbent will be responsible for assisting with the implementation and maintenance of all necessary processes and procedures in order to provide assurance on the level of regulatory compliance within the organisation.

Description

  • Provide assurance on the level of regulatory compliance within the organisation, in respect of the areas specifically assigned to this role, to all relevant stakeholders. In order to achieve this, the following activities will be required.              
  • Initiate and contribute to the review of, and properly maintain the Compliance Requirement Universe for the organisation, in respect of the areas specifically assigned to this role, in order to ensure the accuracy and completeness of this universe.
  • Initiate and contribute to the review of all critical organisational policies, as may be required from a regulatory compliance perspective, on at least an annual basis, in respect of the areas specifically assigned to this role. Once the necessary amendments, if any, have been made, the policy(ies) must be submitted to the Head of Compliance for review and submission to the appropriate forum for approval. In addition, the organisations Policy Register must be appropriately maintained.
  • Participate in the review and/or development of an appropriate Compliance Monitoring Plan, in respect of the areas specifically assigned to this role, in order to ensure completeness and accuracy. The proper maintenance of the Compliance Monitoring Plan must be initiated where appropriate; and cognisance to the combined assurance initiatives must be given during the review process. The Compliance Monitoring Plan must then be appropriately implemented.
  • Contribute to, implement and maintain, where appropriate in respect of the areas specifically assigned to this role, the regulatory compliance breach management and follow-up process which will at a minimum address the identification, analysis and resolution processes to be followed as well as the escalation procedures.
  • Contribute to, implement and maintain, where appropriate in respect of the areas specifically assigned to this role, the process to ensure that the reporting of compliance activities and instances of non-compliance, both internal and external, are relevant, complete, accurate and to the point, and submitted on time.
  • Contribute to, and maintain, where appropriate in respect of the areas specifically assigned to this role, an appropriate oversight function in respect of any activities outsourced, and/or in respect of any independent compliance function(s) performed by any legal entities within the organisation.
  • Contribute to, initiate and maintain, where appropriate, in respect of the areas specifically assigned to this role, regular Interaction with internal and external stakeholders as well as the wider compliance community within the organisation. Stakeholders include, amongst others, the following: Regulators, Supervisors, Industry bodies, Internal and External Audit, Clients, etc.
  • Contribute to the initiation of critical statutory projects relevant to the organisation, in respect of the areas specifically assigned to this role, and monitor the appropriate implementation thereof by the business.
  • To provide support services to all relevant stakeholders within the organisation (Value Add), in respect of the areas specifically assigned to this role.   
  • Contribute to, initiate and/or provide appropriate awareness and training in respect of the areas specifically assigned to this role. Activities may include, amongst others, informing the business of new compliance requirement developments, providing guidance on the potential impact thereof on the organisation, and to identify compliance risks/weaknesses in general for which the business should consider additional mitigating action, or processes and/or procedures.
  • Contribute to, initiate and/or provide professional advice and guidance to business as may be required from time to time, in respect of the areas specifically assigned to this role.
  • Initiate and/or contribute and/or prepare the necessary for the submission of business enabling statutory applications to applicable regulatory and industry/supervisory bodies, in respect of the areas specifically assigned to this role.

Requirements

  • A relevant degree (BCom with specialisation in finance or investments, or BCom Law, or LLB with relevant compliance experience) and/or compliance qualification(s) is a must.
  • A BCom Honours, MBA, CFA, and Post Graduate Diploma in Compliance will be an added advantage.
  • At least 5 –; 8 years relevant compliance/risk management experience (working knowledge), amongst others, in terms of the.
  • Collective Investment Schemes Control Act.
  • ASISA Codes, Standards and Guidelines.
  • Collective Investment Scheme in Securities environment (both traditional and ETFs).
  • Foreign Collective Investment Scheme environment.
  • Collective Investment Scheme in Hedge Funds environment.
  • Comply with the FAIS honesty and integrity requirements.
  • Comply with the FAIS honesty and integrity requirements.
  • Not be an un-rehabilitated insolvent, have entered into a compromise with a creditor, or have been provisionally sequestrated or liquidated.
  • Be registered as, or qualify to be registered as a FAIS Compliance Officer.              
  • CATEGORY I.
  • CATEGORY II - Discretionary FSP.
  • CATEGORY IIA - Hedge Fund FSP (will be of an advantage).
  • CATEGORY III - Administrative FSP.
